Terms of Use
Last Updated: October 6, 2026
These Terms of Use (“Terms”) govern your access to and use of the Tempo Chorus website and publicly available digital services provided by Tempo Hospitality Group, LLC (“Tempo,” “we,” “us,” or “our”).
Please read these Terms carefully.
By accessing or using the Tempo Chorus website or services covered by these Terms, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use the website or services.
Restaurant customers who subscribe to Tempo Chorus may also be subject to a separate proposal, order form, statement of work, service agreement, subscription agreement, or other written agreement with Tempo. If there is a conflict between these Terms and a separately executed customer agreement concerning paid Chorus services, the customer agreement will control for those services.
1. Tempo Chorus
Tempo Chorus provides technology and related services designed to help restaurants manage guest communication, marketing, reputation, websites, menus, inquiries, private events, catering, guest relationships, AI-assisted communications, and related activities.
Features may change, be added, removed, or updated over time.
Certain Chorus features may rely on third-party technology, integrations, telecommunications providers, artificial intelligence providers, or other services.
2. Eligibility
You must be legally capable of entering into a binding agreement to use services that require an account or contractual relationship.
If you use Chorus on behalf of a restaurant, company, or other organization, you represent that you have authority to act on behalf of that organization.
3. Accounts and Security
Certain Chorus services require an account.
You are responsible for:
- Providing accurate account information
- Maintaining the confidentiality of login credentials
- Controlling access provided to employees or other authorized users
- Promptly notifying Tempo of suspected unauthorized access
- Activities performed through your account by authorized users
You may not attempt to gain unauthorized access to another customer's account or to any system, network, or data associated with Chorus.
4. Acceptable Use
You agree not to use Tempo Chorus to:
- Violate applicable laws or regulations
- Send unlawful spam or unsolicited communications
- Harass, threaten, deceive, or impersonate others
- Infringe intellectual-property, privacy, publicity, or other rights
- Distribute malicious software or harmful code
- Interfere with the operation or security of Chorus
- Attempt unauthorized access to systems or information
- Collect or use personal information unlawfully
- Misrepresent your identity or affiliation
- Use Chorus for fraudulent, deceptive, abusive, or unlawful activity
Tempo may suspend or restrict access when reasonably necessary to protect Chorus, our customers, guests, technology providers, or others.
5. Customer Responsibilities
Restaurant customers are responsible for the information, content, policies, offers, menus, pricing, hours, reservation rules, event information, guest communications, and other materials they provide or configure through Chorus.
Customers are responsible for ensuring that their use of Chorus complies with applicable laws, including requirements relating to:
- Privacy
- Email marketing
- Text messaging
- Telephone communications
- Automated communications
- Call recording
- Artificial intelligence
- Consumer protection
- Advertising
- Accessibility
- Intellectual property
Tempo provides tools that may assist with these activities, but use of Chorus does not by itself make a restaurant compliant with every law or regulation applicable to its business.
6. Communications and Messaging
Certain Chorus features allow restaurants to communicate with guests by email, text message, telephone, chat, or other channels.
Customers are responsible for obtaining and maintaining any consent required to send communications through Chorus.
For marketing text messages:
- Consent is not a condition of purchase.
- Message frequency may vary.
- Message and data rates may apply.
- Recipients may reply STOP to opt out.
- Recipients may reply HELP for assistance.
Customers may not use Chorus to send communications to individuals who have not provided required consent or who have opted out, except where communications are otherwise permitted by law.
7. AI-Assisted Features
Chorus may provide features that use artificial intelligence or automated systems, including Tempo AI Host Helper and tools that assist with communications, content, reviews, or workflows.
AI-generated content may contain errors, omissions, or unexpected results.
Restaurant customers are responsible for reviewing the information used to configure AI-assisted services and determining whether outputs are appropriate for their business.
AI-assisted services should not be relied upon for emergency services, medical advice, legal advice, or other high-risk decisions.
Tempo may modify, limit, suspend, or discontinue AI functionality as technology, providers, laws, or operational requirements change.
8. Third-Party Services
Chorus may integrate with, link to, or rely on third-party products and services.
These may include reservation systems, ordering systems, point-of-sale systems, social networks, review platforms, mapping services, telecommunications providers, payment processors, hosting providers, and other restaurant technology.
Your use of a third-party service may be governed by that provider's own terms and privacy policies.
Tempo does not control and is not responsible for third-party services, including changes, outages, errors, pricing, functionality, or availability outside Tempo's control.
9. Intellectual Property
Tempo Chorus, the Tempo name, logos, designs, software, website, documentation, graphics, and other Tempo-created materials are owned by Tempo or our licensors and are protected by applicable intellectual-property laws.
Except as expressly permitted, you may not copy, reproduce, modify, distribute, sell, sublicense, reverse engineer, or create derivative works from Tempo's proprietary materials.
Restaurant customers retain ownership of their own restaurant names, logos, photography, menus, written content, and other materials they provide to Tempo, subject to the rights reasonably necessary for Tempo to provide the services.
Specific ownership provisions for custom websites, creative work, or other deliverables may be governed by the applicable customer agreement.
10. Feedback
If you voluntarily provide suggestions, ideas, or feedback about Chorus, Tempo may use that feedback to improve our products and services without obligation to compensate you, provided we do not publicly identify you as the source without permission.
11. Availability and Changes
We work to provide reliable services, but Chorus may occasionally be unavailable due to maintenance, updates, third-party outages, telecommunications issues, internet failures, security events, or circumstances outside our reasonable control.
We may update or change Chorus as the product evolves.
Unless specifically guaranteed in a written customer agreement, we do not guarantee that every feature will always be available or operate without interruption.
12. No Guarantee of Business Results
Chorus is designed to help restaurants improve guest communication, marketing, follow-up, and related activities.
However, Tempo does not guarantee any particular number of reservations, guests, reviews, leads, event bookings, revenue, profit, search ranking, or other business result.
Actual results depend on many factors outside Tempo's control.
13. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE WEBSITE AND SERVICES COVERED BY THESE TERMS ARE PROVIDED “AS IS” AND “AS AVAILABLE.”
TEMPO DISCLAIMS WARRANTIES NOT EXPRESSLY PROVIDED IN A SEPARATE WRITTEN AGREEMENT, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE EXTENT PERMITTED BY LAW.
Some jurisdictions do not allow certain warranty exclusions, so portions of this section may not apply to you.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TEMPO AND ITS OWNERS, OFFICERS, EMPLOYEES, AFFILIATES, CONTRACTORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE WEBSITE OR SERVICES COVERED BY THESE TERMS.
Any additional limitations applicable to paid Chorus services may be stated in the customer's separate agreement with Tempo.
Nothing in these Terms limits liability that cannot lawfully be limited.
15. Privacy
Our collection and use of personal information is described in our Privacy Policy.
Restaurant customers are also responsible for maintaining appropriate privacy disclosures for information they collect from their guests through Chorus.
16. Termination or Suspension
Tempo may suspend or terminate access to services covered by these Terms when reasonably necessary because of:
- Violation of these Terms
- Unlawful or abusive activity
- Security concerns
- Nonpayment under an applicable customer agreement
- Risk to Tempo, our providers, customers, or users
- Legal or regulatory requirements
Terms that by their nature should survive termination will remain in effect.
17. Governing Law
These Terms are governed by the laws of the State of Minnesota, without regard to conflict-of-law principles, except where applicable law requires otherwise.
Any venue, arbitration, dispute-resolution, or other procedures contained in a separately executed agreement between Tempo and a restaurant customer will control disputes governed by that agreement.
18. Changes to These Terms
We may update these Terms as Chorus and our services evolve.
The updated Terms will be posted on this page with a revised “Last Updated” date. Where required by law or contract, we will provide additional notice.
Your continued use of the website or applicable services after updated Terms become effective constitutes acceptance of those Terms to the extent permitted by law.
